BUYING BANK OWNED PROPERTIES
There is a lot of interest in buying bank owned properties these
days. A lot of information, some good and some bad, is floating
around about the subject. Often the information offered is for sale,
with the promise that you can make a lot of money with little effort
once you know the secret formula. The fact is that there are no
secrets, and to make money does require effort.
WHAT ARE "REO's"?
An REO (meaning real estate owned) is a property that goes back
to the original lender after the foreclosure process has run it
course. Given that the market is currently flood with foreclosures,
most foreclosure auctions result in the lender being the sole bidder
on a particular property. In far too many cases, there was not
enough equity in the property to satisfy the loan after sale. In a
foreclosure sale, the lender will generally bid an amount that
includes the loan balance, accrued interest, attorney's fees and
foreclosure costs. Any other liens that are attached and junior to
the foreclosed loan are extinguished by the sale. Very few
foreclosure auctions result in a successful sale on the courthouse
steps. After the process is complete, the property "reverts" to the
lender. It becomes an REO, or "real estate owned" property.
REO'S vs FORECLOSURE PROPERTIES
REO Properties (Real Estate Owned) are properties that have gone
back to the mortgage company after an unsuccessful foreclosure
auction. You see, most foreclosure auctions do not even result in
bids. After all, if there was enough equity in the property to
satisfy the loan, the owner would have probably sold the property
and paid off the bank. That is why the property ends up at a
foreclosure or trustee sale.
Foreclosure sales begin with a minimum bid that includes the loan
balance, any accrued interest, plus attorney's fees and any costs
association with the foreclosure process. In order to bid at a
foreclosure auction, you must have a cashier's check in your hand
for the full amount of your bid. If you are the successful bidder,
you receive the property in "as is" condition, which may include
someone still living in the property. There may also be other liens
against the property.
Since what is owed to the bank is almost always more than what
the property is worth, very few foreclosure auctions result in a
successful sale. Then the property "reverts" to the bank. It becomes
an REO, or "real estate owned" property. |
